 1. The Promoter 

The promoter is: SAPIO RESEARCH LTD of Floor 2, 52-54 Southwark Street, London SE1 1UN, company registration number 10378863 (the “Promotor”).

2. Competition overview 

2.1 The title of the competition is SAPIO CHARITY RESEARCH GIVEAWAY.

2.2 Win an online consumer research survey up to the value of £4,900:

a) for use by the charities sector only;

(b) by submitting an eligible research brief in accordance with these terms and conditions.

3. How to enter 

The competition will run from 5th October 2023 to 11:59pm on 16th November 2023 (the “Closing Date“) inclusive.

3.2 The Promoter reserves the right to extend the Closing Date in the event that the Promoter has not received the minimum number of qualifying entries by the Closing Date.

3.3 To enter the competition you will need to submit a research brief using the online entry form provided here by the Closing Date.

3.4 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.5 The Promoter will not accept responsibility for competition entries not received for whatever reason.

4. Eligibility

4.1 The competition is open to:

(a) all registered charities and not for profit organisations with a UK consumer base; and

(b) agencies acting on behalf of an entity referred to in (a) above,

except where a person professionally connected with the Promotor or otherwise with the organisation or administration of the competition (or a member of the immediate family or household of such person), is an employee, director, member, partner, agent or consultant of, or person indirectly or directly in control of, the registered charity or not for profit organisation.

4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition.

4.3 There is a limit of one entry to the competition by or on behalf of each registered charity / not for profit organisation.

5. The prize 

5.1 The prize is a free online consumer research survey to the equivalent value of £4,900 plus VAT.

5.2 The survey will include a total of 25 questions (including any demographics). A maximum of 2,000 individuals will be contacted as part of the survey (the exact number of contacted individuals will depend on the winner’s chosen sample audience). The survey audience must be based in the UK.

5.3 The prize includes advice from the Promotor on the content of the survey and feedback on the responses received. Feedback will be presented in the form of Excel tables and a PowerPoint report. The prize does not include full questionnaire design services but these can be provided on request for an additional fee.

5.4 Timeframes around the winner’s acceptance and use of the prize are set out in sections 6.3 and 6.6.

5.5 There is no cash alternative for the prize. The Promoter reserves the right to substitute the prize with a prize of equal or greater value.

5.6 The prize is not transferable.

5.7 Any costs or expenses incurred in respect of items not specifically included in the prize are for the winner’s own account. The Promoter will not be responsible for any expenses that the winner may incur as a result of their acceptance and/or use of the prize, whether foreseeable or not.

6. Award of the prize 

6.1 The winner will be selected from all eligible entries received before the Closing Date using a random generator tool. The Promotor will be entitled to exclude from the competition any entry containing false, incomplete or misleading information, or any entry otherwise submitted in breach of these terms and conditions.

6.2 The Promoter’s decisions in respect of all matters to do with the competition will be final and no correspondence or discussion will be entered into.

6.3 The Promoter will notify the winner of the prize within 2 working days of the Closing Date, using the telephone number or email address provided with the winner’s competition entry. The winner will have 3 working days from notification by the Promoter to confirm their acceptance of the prize.

6.4 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, or has not confirmed acceptance of their prize within 3 working days of notification, the Promoter reserves the right to offer the prize to a replacement winner, randomly selected from the remaining eligible entries that were received before the Closing Date.

6.5 The Promoter does not accept any responsibility if you, as the winner, are unable to take up the prize.

6.6 The winner must work with the Promotor to enable a launch date for the survey which is no later than 3 months after the Closing Date.

6.7 If the winner fails to comply with these terms and condition including the terms of acceptance of the prize, this will be construed as a rejection of the prize and, without prejudice to any other remedy which the Promoter may have, the winner will be automatically disqualified and will forfeit the prize.

6.8 The winner’s name will be available to anyone who emails charities@sapioresearch.com within 28 days after the Closing Date.

7. Limitation of liability 

Insofar as is permitted by law, the Promoter will not in any circumstances be liable for any loss (including without limitation indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this competition or accepting or using the prize.

8. Ownership of competition entries, intellectual property rights and publicity

8.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.

8.2 By submitting your competition entry and any accompanying material, you agree to:

(a) assign to the Promoter all your intellectual property rights with full title guarantee; and

(b) waive all moral rights,

in and to your competition entry and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

8.3 You agree that the Promoter may, but is not required to, make your entry available as a case study on its website and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and any accompanying materials, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and any accompanying materials for such purposes.

9. Data protection

9.1 Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent. The Promoter will only process personal information as set out in the https://sapioresearch.com/privacy-policy.

10. General 

10.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.

10.2 The Promoter reserves the right to hold void, suspend, cancel or amend the competition and/or these terms and conditions without notice in the event of a catastrophe, war, pandemic, civil or military disturbance, act of God or any actual or anticipated breach of any applicable law or regulation or any other event outside of the Promoter’s control.

10.3 These terms and conditions shall be governed by English law, and any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
